Writ Petitions

At Delhi Legal Beagle, we provide legal assistance and representation in writ petition matters involving violations of legal rights, unlawful administrative actions, and failures by public authorities to perform their statutory duties. Our services cover constitutional remedies under Articles 32 and 226 of the Constitution of India, helping individuals, organisations, and eligible parties seek judicial intervention in appropriate cases.

We assist clients in assessing the maintainability of a writ petition, examining government orders and official records, identifying relevant legal grounds, and preparing petitions and supporting documents. Depending on the nature of the dispute and the jurisdiction involved, we assist with proceedings before the Delhi High Court, the Supreme Court of India, and other competent High Courts. Each matter is evaluated according to the applicable law, available evidence, and relevant procedural requirements.

Frequently Asked Questions

A writ petition is a legal proceeding through which a person or eligible party seeks a constitutional remedy from a competent court against unlawful action, certain legal violations, or failure to perform a public duty.

The Supreme Court can issue writs for the enforcement of fundamental rights under Article 32 of the Constitution. High Courts can issue writs under Article 226 for the enforcement of fundamental rights and for other legally recognised purposes within their jurisdiction.

The five constitutional writs are Habeas Corpus, Mandamus, Certiorari, Prohibition, and Quo Warranto. Each serves a distinct legal purpose and is available subject to applicable legal requirements.

Documents may include the challenged order, official correspondence, representations submitted to authorities, supporting evidence, relevant service or property records, affidavits, and other materials connected with the grievance. Requirements depend on the nature of the petition and the court’s rules.

The Constitution does not prescribe one universal limitation period for all writ petitions. However, courts may consider delay, laches, the nature of the grievance, and other relevant circumstances when deciding whether to entertain a petition. It is advisable to seek legal advice promptly.
